General Terms and Conditions (GTC) — The Swiss Lake Twins (Boat Tours / Experiences)

1. Provider / Operator
The services offered under “The Swiss Lake Twins” are provided by:

2. Scope of application
These GTC apply to all bookings and agreements related to boat tours, cruises, private charters and experience services marketed as “The Swiss Lake Twins” (the “Services”), unless a separate written agreement has been concluded between the provider and the customer.
3. Booking and contract conclusion
A contract is concluded when the customer completes the booking process (online or otherwise confirmed in writing) and the provider confirms the booking, or when payment is successfully completed (depending on the booking flow).
4. Prices, payment, and vouchers
- All prices are shown in the booking flow and are payable using the payment methods offered at checkout.
- Unless otherwise stated, bookings must be paid in advance.
- Vouchers / promo codes are valid only under the conditions shown at the time of purchase / issuance.
5. Weather conditions (rain, storm) & safety decisions
Safety is the highest priority. Tours may be adapted, delayed, rescheduled, or cancelled if weather conditions (including rain, storms, strong wind, fog, or other hazardous conditions) make the trip unsafe or significantly reduce safety and operational feasibility.
- The decision is made by the provider/captain based on safety considerations and official/local conditions.
- If conditions allow safe operation, tours generally take place even in rain (e.g., with reduced route or speed).
- In case of a storm or unsafe conditions, the tour will be cancelled or rescheduled.
If a tour is cancelled by the provider due to unsafe weather, the customer may choose:
- Free rebooking to a mutually available date/time, or
- Refund of the paid tour price (excluding any non-refundable third-party fees where applicable).
6. Cancellation and rebooking (customer)
The customer may cancel or request rebooking by contacting the provider in writing (email is sufficient). The applicable deadline is based on the scheduled start time of the tour.
- More than 7 days before the tour: free cancellation or free rebooking.
- 7 days to 48 hours before the tour: rebooking possible; otherwise 50% cancellation fee.
- Less than 48 hours before the tour / no-show: 100% cancellation fee.
If the provider agrees to rebook within the same season, any paid cancellation fee may be credited toward the new date, at the provider’s discretion and subject to availability.
7. Late arrival
Customers are responsible for arriving on time at the agreed meeting point. Late arrival may reduce the tour duration. If the customer arrives too late to start the tour, it may be treated as a no-show.
8. Passenger conduct and safety rules
- Customers must follow captain instructions at all times.
- Alcohol may be restricted if safety requires it.
- The provider may refuse service to passengers whose behavior endangers safety.
9. Liability
The provider is liable only for damages caused intentionally or by gross negligence, to the extent permitted by law. Liability for indirect or consequential damages is excluded to the extent legally permissible.
10. Applicable law and jurisdiction
Swiss law applies. The place of jurisdiction is Sursee (Canton of Lucerne, Switzerland), unless mandatory provisions provide otherwise.

In this Privacy Policy, QUTTING EDGE SWISS GMBH explains how we collect and process personal data. This statement complies with the requirements of the Swiss Data Protection Act (DPA), the revised DPA (revDPA) and the EU General Data Protection Regulation (GDPR).

2. Collection and processing of personal data
We process personal data that we receive in the course of customer or business relationships, or when our website and digital services are used. This may include, in particular:

5. Newsletter
We send newsletters only with your explicit consent. You can revoke this consent at any time using the unsubscribe link in the email. After unsubscribing, your email address may be added to a suppression list to prevent further mailings.
6. Data sharing and international transfers
Personal data is disclosed to third parties only to the extent necessary for the purposes listed above, including:
- Service providers (e.g. IT, logistics, and payment providers)
- Customers, partners and suppliers involved in contractual relationships
- Authorities, courts and public bodies where legally required
- Companies within the QUTTING EDGE SWISS GMBH corporate structure

We store personal data only for as long as is necessary to fulfil the relevant purpose or as required by applicable law. Afterwards, the data is deleted or anonymized.

9. Obligation to provide data
Certain personal data is required to conclude or perform contracts. Without this data, the provision of our products or services may not be possible.

11. Amendments

General Terms and Conditions (GTC) — Marine & Boat Equipment Division (AirBerth®)

12. Scope of application
These General Terms and Conditions (GTC) apply to all business relationships related to the marine and boat equipment division (including AirBerth® systems, accessories and related services) of QUTTING EDGE SWISS GMBH, in the version current at the time of conclusion of the contract, unless a separate written agreement has been concluded between the company and the customer.
The GTC apply exclusively. Any terms and conditions of the customer that conflict with or deviate from these GTC shall not be accepted, unless explicitly recognized in writing.
Should individual provisions be or become invalid, this shall not affect the validity of the remaining provisions.
13. Delivery times
The delivery periods stated by QUTTING EDGE SWISS GMBH are not binding – unless otherwise agreed in writing – but will be adhered to wherever possible. Partial deliveries are permitted; no additional costs shall result for the customer.
In the event of delays beyond the company’s control, the customer shall not be entitled to withdraw from the contract or claim damages.
14. Transportation / Delivery
Ex warehouse, or FCA Sursee-LU (FCA according to Incoterms 2020).
15. Binding nature of offers
The offers of QUTTING EDGE SWISS GMBH are valid for 30 days from the date of the offer.
16. Price changes
If at least three months elapse between the conclusion of the contract and delivery, QUTTING EDGE SWISS GMBH reserves the right to adjust prices due to changes in raw material costs, taxes, duties, or currency fluctuations.
17. Terms of payment
- Online orders via the webshop are payable immediately during the ordering process using secure payment methods available in the webshop.
- For retail customers, invoices are payable net (without deductions) within 14 days of the invoice date, unless otherwise agreed.
- After this period, default interest and reminder fees of CHF 50.00 per notice apply.
18. Warranty / Liability
QUTTING EDGE SWISS GMBH grants a warranty on new goods ex works under the manufacturer’s warranty. Customers are entitled to defect-free goods and must inspect them upon receipt.
Defects must be reported immediately and in writing; otherwise, the goods shall be deemed accepted.
19. Color / Material behavior
Colors or surface appearance may vary slightly over time due to sunlight or environmental conditions. Such changes and natural material aging do not constitute defects.
All AirBerth® systems and accessories are designed for marine environments and comply with applicable safety and environmental standards for inland waters in Switzerland and the EU.
20. Retention of title
Goods remain the property of QUTTING EDGE SWISS GMBH until full payment has been received.
21. Extraordinary events (force majeure)
In the event of force majeure (e.g. war, natural disasters, epidemics or pandemics) and other unforeseeable events, QUTTING EDGE SWISS GMBH may withdraw from contractual obligations in whole or in part without liability for damages.
22. Data
QUTTING EDGE SWISS GMBH processes and stores customer data as required for contract fulfillment. Further information on data protection can be found under “Legal” on our website.
23. Applicable law / Jurisdiction
Swiss law applies. The place of performance and jurisdiction is Sursee (Canton of Lucerne, Switzerland).
